National Public Health Centre under the Ministry of Health
• Performs the functions of the national authority for the implementation of the Regulation (EC) No.123/2009 of the European Parliament and of the Council of 30 November Regulation (EC) No. 1223/2009 on cosmetic products (OJ 2009 L 342, p. 59).
• Performs state public health safety control based on (EB) Nr. 1223/2009 of legal persons, state enterprises, municipal enterprises, public institutions, as well as branches of foreign legal person or organizations which manufacture cosmetic products or make them available on the EC market acting as responsible person if product is taken not from EU countries.
• Deals with consumer complaints about cosmetic products.
• Supervises how those who have responsibility for cosmetics products follows the obligations referred to in Article 5 of Regulation (EC) No. 1223/2009.
• Carries out the tasks of The national measures referred to Regulation (EC) No.1223/2009 in the first and second paragraphs of Article 22, Article 23 (2), (3), (4) and (5), Article 24, Article 25 (1) to (6), Article 27, Article 28, Article 29 (1), Article 30 and functions of the competent authority.
State Consumer Rights Protection Authority
• Supervises how distributors follow the obligations referred to in Articles 6 and 13 (3) of Regulation (EC) No. 1223/2009).
• Within its field of competence, carries out the provisions of Regulation (EC) No. 1223/2009 and functions of the national authority as defined in the first paragraph of Article 22, Article 25 (1) (b) to (j) and (l) and (5) and (7), Articles 26, 28 and 29 (1).
Ministry of Health of the Republic of Lithuania
• Provides Regulation (EC) No. 1223/2009 Request for authorization pursuant to the sixth subparagraph of Article 18 (2) to the Commission Derogation from Article 18 (1) of Regulation (EC) No 1223/2009.
• Enforcement of Regulation (EC) No. The obligation laid down in the fourth paragraph of Article 22 of Regulation (EC) No 1223/2009 at least every four years. The competent national institutions should overlook cosmetic products by Regulation (EC) No 1223/2009 and make the results and the evaluation available to the other Member States of the European Union and the Commission and make them available to the public.
Customs of the Republic of Lithuania
• Within its competence does the supervision whether cosmetic products imported from third countries are legalized.
• Fills in a report on detained cosmetic products and sends it to the Territorial Department of the National Center of Public Health.
State Medicines Control Agency of Lithuania
• One of the cooperating institutions considering whether an existing product is a cosmetic product or nevertheless drug.
Food and Veterinary State Service
• consultative, cooperative institution to determine whether an existing product has the properties of a food or nutritional supplement or nevertheless is classified as a cosmetic product.
